How does overtime work?
Overtime refers to any hours worked by an employee that exceed the agreed ordinary number of hours. If a Hireup support worker works over 10 hours in a day (a day is from 12.01am to 11.59pm of a calendar day) and/or over 76 hours a fortnightly pay period (14 days inclusive of Monday 12.01am to Sunday 11:59pm of each pay period), they are entitled to overtime.
All of our support workers sign an employment contract that states: You are not permitted to work any additional hours outside of the hours confirmed in each Booking, or in excess of 38 hours per week or 76 hours per fortnight without prior written approval from Hireup.
We understand that there are unique circumstances where a worker may need to work more than 10 hours a day or 76 hours a fortnight, but please keep in mind your physical and mental health. The wellbeing and safety of our support workers and the community is important to Hireup and our workers should not be working beyond their capacity.
Overtime process
The overtime calculation for impacted support workers is applied once a worker has submitted their hours and these have been approved by the people they support. Our Finance team processes this every 2nd Monday.
Support workers will only be able to see if they are paid overtime in their payslip. Overtime calculations are not shown on the Hireup platform.
Overtime rates
Our level 1 overtime hourly rates are as follows (excluding super, inclusive of casual loading):
Day |
Normal rate |
First 2 hours overtime |
After 2 hours of overtime |
% x base rate |
Monday - Saturday |
$31.52 - $35.31 (Weekday) $43.78 (Sat) |
$43.78 |
$56.40 |
1.5x base rate for first 2 hours 2x base rate after 2 hours |
Sunday |
$56.40 |
$56.40 |
2x base rate |
|
Public holiday |
$69.36 |
$69.36 |
2.5x base rate |
Overtime rates for Saturdays (for first 2 hours), Sundays (any hours) and public holidays (any hours) are equal to normal Sat, Sun & public holiday rates. That’s because we already pay at 1.5x, 2x and 2.5x base rate respectively for those hours in accordance with SCHADS penalty rates.
Example scenarios of overtime if you work over 10 hours a day
- If I work 13 hours on a weekday = 10 hours x $35.31 + (first) 2 overtime hours x $43.78 + 1 further overtime hour x $56.40
- If i work 13 hours on a Saturday = 10 hours x $43.78 + (first) 2 overtime hours x $43.78 + 1 further overtime hour x $56.40
- If i work 13 hours on a Sunday: = 10 hours x $56.40 + 3 hours x $56.40
Meal allowance
Support workers who work overtime and cannot reasonably return home for a meal break may be eligible for meal allowances. You can request this via the below form. A meal allowance will not be approved if we determine you could reasonably return home to have a meal. https://hireup.com.au/form/support-worker-meal-allowance/
How does this impact you?
Below you’ll find some answers to some specific scenarios.
Overtime and sleepovers
- Does a sleepover count towards overtime?
A sleepover is a 12 hour booking, made up of 8 hours of sleep (including 1 hour of assistance during the night) and 4 hours of support before and/or after the sleep component. This counts as 5 hours of work and can count towards overtime hours.
- What if I do a 2nd active hour in a sleepover, does that count towards overtime?
If you work a 2nd active hour during a sleepover this counts as work performed and so will count in your overtime calculation.
- What time of day are the active hours in a sleepover allocated to in relation to calculating daily overtime?
To simplify the process for you, we have assigned the first active hour at the start of the 8 hour sleeping block and the 2nd active hour, if applicable, at the end of the 8 hour sleeping block.
If this is not the case when working a sleepover, and this could impact your overtime calculations, please contact payroll@hireup.com.au and we will adjust this for you.
- Do sleepover compliance hours count towards overtime?
No they don’t, compliance hours technically aren't worked, but are paid to meet minimum requirements of the SCHADS award. So they don’t count towards worked hours for the purpose of overtime calculations.
Overtime and time of day
- What happens to my overtime if I do more than 10 hours on a weekday and the shifts are from day to evening, night to day etc?
Overtime rates are paid in substitution for shift allowances and so there’s just one overtime rate for a weekday, a Saturday, a Sunday and a public holiday. The overtime rate doesn’t change according to time of day, so shift allowances do not apply.
Overtime different pay levels
- What happens if I work more than 76 hours a fortnight and I work for different clients on different pay levels?
You will be paid at the applicable rate which triggers your entitlement to overtime.
Overtime and public holidays
- What happens if I work over 10 hours and I start work on a public holiday and finish on a non public holiday, will I get paid public holiday overtime rates?
If you are required to work on a public holiday you will be paid double time and a half of your ordinary rate.
Overtime >10 hours a day and >76 hours a fortnight
- What overtime will I get paid if I work over 10 hours a day and also over 76 hours a fortnight?
You will be paid overtime in both of those scenarios. So, if you work more than 10 hours a day, you will receive overtime for those hours, and you will also receive overtime on the hours you work beyond 76 a fortnight. If you happen to work beyond 76 hours for a fortnight which is also a shift that is longer than 10 hours a day on the same shift, you will still be paid overtime on both of those overtime triggers. For example, if you work 13 hours on one shift and that shift pushes you over the 76 hour a week threshold, both overtime triggers will be satisfied
- What happens if I do over 76 hours in a fortnight, but my client doesn't approve one of my shifts until the following payrun?
If you are entitled to overtime in a fortnight, but not all shifts have been approved within the fortnight that the 76 hours occured, you will get paid overtime for the applicable, respective fortnight when those shifts are approved by the person you support.
